01Acceptance of these Terms
These Terms of Use govern your access to and use of N5 Gilded Masquerade (the “Game”) and this legal website. By installing, accessing or using the Game, or by tapping Agree, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Game and tap Decline. Decline leaves you on this consent screen; you can close the app yourself.
02Who we are
The Game is provided by TRES AMIGOS IMPORTING, LLC, 30 N Gould St, Ste 35843, Sheridan, WY 82801-6317, United States (“we”, “us”, “our”). These Terms are a contract between you and us. The app store is not a party to these Terms and has no responsibility for the Game, except as its own terms require.
03Eligibility
You must be at least 18 years old, or the legal gambling age in your jurisdiction if that is higher, and legally capable of entering into these Terms. You must not use the Game where it is unlawful or prohibited. If you use the Game on behalf of someone else, you confirm that you are authorised to do so.
04Licence to use the Game
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use the Game on devices you own or control, for private entertainment. You may not sublicense, rent, lease, distribute or otherwise make the Game available to others. The app store's own terms also apply.
05Virtual credits — no real money
The Game is a virtual-credit game. All balances, bets and wins are virtual credits with no monetary value. They cannot be purchased, sold, transferred, exchanged or redeemed for money, goods or anything of value, and they have no value outside the Game. The Game does not accept deposits and does not pay out prizes. It is not real-money gambling.
Virtual credits may be reset, corrected or adjusted if the Game detects an error, abuse, tampering or a change in configuration. You do not own the credits, and they do not represent a claim against us.
06Randomness and gameplay
Outcomes are determined by a random number generator and the rules of the Game. Past results do not predict future results. We do not guarantee any particular win, balance, feature or availability. Game parameters, including bet limits, feature frequency and caps, may be updated remotely.
07Availability and updates
We may update, patch, suspend, withdraw or discontinue the Game or any feature at any time. We do not guarantee uninterrupted or error-free operation. Maintenance, network, device or store issues may affect access.
08Acceptable use
You must not:
- reverse engineer, decompile, disassemble or derive the source code of the Game, except to the extent permitted by law;
- modify, patch, cheat, use bots or automation, exploit bugs, or bypass security, integrity, age or location controls;
- access the Game without authorisation, probe or scan our systems, introduce malware or disrupt the service;
- scrape, copy, frame, mirror or commercially exploit the Game or its content;
- use the Game for real-money gambling or any unlawful purpose;
- infringe the rights of others or harass other people;
- remove or alter proprietary notices.
09Intellectual property
The Game, including its code, artwork, audio, symbols, text, marks and design, is owned by us or our licensors and protected by law. These Terms grant only the limited licence described above. You may not use our names or marks without written permission.
If you send us feedback, you grant us a perpetual, worldwide, royalty-free licence to use it without obligation to you. If you believe content in the Game infringes your rights, contact us with details so we can review it.
10Third-party services and stores
The Game uses Adjust and relies on the app store and your device operating system. Those services have their own terms and privacy policies. We do not control them and are not responsible for their acts. Links on this website are provided for convenience; their content is not ours.
11Changes to these Terms
We may update these Terms from time to time. The new version will be posted with a new effective date. If a change is material, we will notify you in the Game, on this page or through the store. Continued use after the effective date means you accept the updated Terms to the extent permitted by law. If you do not agree, stop using the Game.
12Termination
We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Game, users or third parties. You may stop using the Game at any time by uninstalling it. Provisions that by their nature should survive termination, including intellectual property, disclaimers, liability and governing law, will continue to apply.
13Disclaimer of warranties
To the maximum extent permitted by law, the Game and this website are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement and uninterrupted operation. Nothing in these Terms excludes rights you have under mandatory consumer law.
14Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, goodwill or opportunity, arising from or related to the Game or these Terms, even if we were advised of the possibility.
Where liability cannot be excluded, our aggregate liability is limited to the greater of: (a) the amount you paid us for the Game in the 12 months before the claim, which is currently zero; and (b) the minimum amount required by applicable law. Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other right that cannot be waived by law.
15Indemnity
To the extent permitted by law, you agree to indemnify us against third-party claims, losses and reasonable costs arising from your breach of these Terms or your misuse of the Game. We will notify you of any such claim and may participate in the defence. This does not apply to claims caused by our own negligence or breach.
16Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws rules. The courts located in Wyoming have jurisdiction, except that mandatory consumer protections in your country may give you the right to bring a claim locally. Before filing a claim, please contact us so we can try to resolve the issue informally.
17General provisions
These Terms and the Privacy Policy are the entire agreement between us regarding the Game. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain in force. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms; we may assign them to an affiliate or successor. No third party has rights to enforce these Terms. Headings are for convenience only. The English version prevails over translations. We may give notices in the Game, on this website or through the store.
